Overview

The terms “TheJeMi,” “we,” “us,” and “our” refer to TheJeMi. We operate this online store and website, including the information, content, features, tools, products, and services made available through it, collectively referred to as the “Services.”

TheJeMi is a curated clothing and accessories destination for women and men. Our collections bring together modern, urban, refined, and versatile products selected for different lifestyles, occasions, and chapters of life. Certain products may be supplied, processed, or shipped by third-party brands, suppliers, warehouses, and fulfillment partners.

TheJeMi is powered by Shopify, which provides the ecommerce platform that enables us to offer the Services.

These Terms of Service, together with the policies referenced in them, describe your rights and responsibilities when you access or use the Services.

By visiting, browsing, interacting with, or purchasing through the Services, you agree to these Terms of Service and our Privacy Policy. If you do not agree, you should not access or use the Services.

1. Access and Accounts

By agreeing to these Terms, you represent that you are at least the age of majority in your state, province, country, or jurisdiction of residence.

You may allow a minor dependent to use the Services only under your supervision and through a device, account, or payment method that you are legally authorized to manage.

When creating an account or placing an order, you may be asked to provide information including:

• Your name
• Email address
• Billing address
• Shipping address
• Payment information
• Telephone number when required for delivery or payment processing

You represent that the information you provide is accurate, current, and complete and that you have the right to provide and use that information.

You are responsible for maintaining the confidentiality of your account credentials and for activity performed through your account. You may not sell, transfer, license, or assign your account to another person.

Please contact us promptly if you believe your account has been accessed without authorization.

2. Our Store and Products

TheJeMi curates clothing, handbags, wallets, sunglasses, and related accessories from third-party brands, suppliers, and fulfillment partners.

Unless a product page expressly states otherwise, products offered through TheJeMi should not be understood to have been designed, manufactured, or produced directly by TheJeMi.

We make reasonable efforts to present product information accurately. However:

• Colors may appear differently depending on screen, device, brightness, lighting, and display settings.
• Product dimensions and measurements may vary slightly.
• Product photography may include styling items that are not included with the purchase.
• Materials, sizing, packaging, labels, and minor product details may be updated by a supplier.
• Actual product appearance may differ slightly because of normal manufacturing, lighting, or display variations.
• Product information may be corrected or updated when additional verified information becomes available.

We may, subject to applicable law:

• Limit quantities available for purchase
• Limit sales by person, household, geographic location, or jurisdiction
• Discontinue or remove a product
• Decline shipment where sale or delivery is restricted
• Cancel an order when inventory is unavailable
• Correct material pricing or product-information errors

Products are offered while supplies last. Adding an item to your cart does not reserve that product.

3. Orders, Cancellations, Returns, Exchanges, and Refunds

When you submit an order, you are making an offer to purchase the selected products.

An automated order confirmation does not necessarily mean that the order has been accepted. An order is generally accepted after payment has been approved and the order is accepted and submitted for fulfillment.

We may accept, reject, limit, or cancel an order for reasons including:

• Product unavailability
• Suspected fraud or unauthorized payment activity
• Materially incorrect pricing or product information
• Shipping restrictions
• Compliance or safety concerns
• Unusual purchasing patterns
• Purchases that appear intended for unauthorized commercial resale
• Inability to verify billing, shipping, payment, or account information

If an order is rejected or canceled after payment has been collected, the eligible amount will be returned to the original payment method.

Cancellations and order changes

Please review your order, shipping address, selected size, color, and quantity carefully before submitting it.

Cancellation or change requests should be submitted as soon as possible. Requests made within 24 hours may be considered, but cancellation or modification is not guaranteed.

Once an order enters processing, fulfillment, or shipment, it may no longer be possible to cancel or change it.

Returns, exchanges, and refunds

Eligible returns, exchanges, store credit, and refunds are governed by our Returns, Exchanges & Refunds Policy .

Depending on eligibility and availability, an approved return may qualify for an exchange, store credit, or a refund to the original payment method.

Exchanges are handled as an approved return followed by a replacement order. Replacement products remain subject to availability.

Do not send a product back before receiving return authorization and the correct return instructions. Products may be fulfilled from and returned to different locations, so the address shown on the original shipment might not be the correct return destination.

Purchases are intended for personal or household use. Products may not be purchased for unauthorized commercial resale, export, or redistribution.

4. Prices, Payments, Discounts, and Promotions

Unless otherwise indicated, prices are displayed and processed in United States dollars (USD).

Prices, promotions, discounts, and product availability may change without notice.

The price charged will generally be the price displayed when the order is submitted, subject to correction of obvious pricing or technical errors as permitted by applicable law.

Product prices do not necessarily include shipping charges, sales tax, or other charges shown separately during checkout.

You agree to provide accurate, complete, and current billing and payment information and represent that you are authorized to use the payment method submitted.

Payment processing may be performed by Shopify or another third-party payment provider. Available payment methods are shown during checkout.

Installment-payment options, when available, are offered subject to the eligibility requirements, terms, and approval of the applicable payment provider. TheJeMi does not determine customer financing approval, repayment schedules, or financing terms.

Promotional offers may have separate rules, eligibility requirements, exclusions, expiration dates, or other conditions. When specific promotion terms conflict with these Terms, the specific terms applicable to that promotion control.

5. Promotional Gift Cards

TheJeMi may offer promotional gift cards as part of qualifying purchases or other promotions.

Under our current promotional offer, a qualifying order with a merchandise subtotal of more than $100 after discounts and before taxes and shipping charges may receive a complimentary $10 TheJeMi promotional gift card for use on a future eligible purchase.

The promotional gift card cannot be applied to the same order that generated it.

If a return, cancellation, refund, or other adjustment causes the merchandise retained from the qualifying order to total $100 or less after discounts, an unused promotional gift card may be canceled.

If the promotional gift card has already been redeemed and the qualifying order is subsequently adjusted below the promotional threshold, $10 may be deducted from the applicable refund, in addition to any other deductions permitted under the Returns, Exchanges & Refunds Policy.

Promotional gift cards cannot be redeemed or exchanged for cash except where required by applicable law.

6. Shipping and Delivery

TheJeMi currently ships to eligible addresses within the United States and supported U.S. territories. Delivery availability is confirmed during checkout.

Canada and other international destinations are not currently supported.

TheJeMi uses third-party suppliers, warehouses, fulfillment partners, and shipping carriers.

Products in the same order may:

• Ship from different fulfillment locations
• Be processed on different schedules
• Arrive in separate packages
• Receive separate tracking numbers
• Be delivered on different dates

Once an order is accepted and submitted for fulfillment, our estimated standard delivery window is generally 5–8 business days. Delivery dates and transit times are estimates rather than guarantees.

TheJeMi is not responsible for delays caused by circumstances outside our reasonable control, including carrier delays, severe weather, transportation disruptions, incorrect or incomplete addresses, failed delivery attempts, labor disruptions, natural disasters, government action, or supplier and fulfillment delays.

You are responsible for entering a complete and accurate shipping address. When an address correction or reshipment is possible, additional shipping charges may apply.

Nothing in this section limits consumer rights that cannot legally be waived.

7. Intellectual Property

The Services and their content—including the TheJeMi name, logos, graphics, website design, written content, collection names, photographs, videos, layouts, and other materials—are owned by or licensed to TheJeMi, its suppliers, Shopify, or other applicable rights holders.

The Services are protected by applicable copyright, trademark, trade-dress, and other intellectual-property laws.

You may use the Services only for personal, lawful, and noncommercial shopping purposes.

Without appropriate permission, you may not:

• Copy or reproduce protected website content
• Republish product images or descriptions
• Modify or commercially exploit protected content
• Scrape or harvest store data in violation of these Terms or applicable technical restrictions
• Use TheJeMi’s name, logo, or branding in a misleading manner
• Suggest an affiliation, endorsement, or partnership that does not exist

The Shopify name and logo are trademarks of Shopify. Other names, marks, and logos displayed through the Services belong to their respective owners.

8. Optional Tools and Third-Party Services

The Services may provide access to applications, payment methods, tracking services, return platforms, social-media features, or other services operated by third parties.

We do not necessarily control those third-party services. Their use may be subject to separate terms, fees, policies, privacy practices, and eligibility requirements.

To the fullest extent permitted by law, TheJeMi is not responsible for losses caused solely by a third-party service or platform outside our reasonable control.

9. Third-Party Links

The Services may contain links to third-party websites or resources for convenience or functionality.

A link does not necessarily mean that TheJeMi controls, endorses, or guarantees the third party or its content.

When you leave TheJeMi and access another website, review that website’s terms, privacy practices, and other applicable policies before providing information or completing a transaction.

10. Relationship with Shopify

TheJeMi is powered by Shopify, which provides technology and ecommerce services that help us operate the store.

Purchases made through TheJeMi are transactions directly between you and TheJeMi. TheJeMi is the seller or merchant responsible for the products and customer transaction.

Shopify is not the seller or merchant of record for products offered by TheJeMi and does not make TheJeMi’s product-selection, pricing, fulfillment, return, refund, or customer-service decisions.

11. Privacy

Personal information collected through the Services is handled in accordance with TheJeMi’s Privacy Policy.

Because the Services are hosted by Shopify, Shopify and other service providers may process information necessary to operate, secure, support, and improve the store and related services.

Information may also be shared with service providers involved in payment processing, order fulfillment, shipping, analytics, customer support, fraud prevention, marketing when permitted, and website operation.

12. Feedback and Submissions

If you submit reviews, photographs, suggestions, comments, ideas, or other content to TheJeMi, you represent that you have the right to provide that content.

You grant TheJeMi a worldwide, nonexclusive, transferable, sublicensable, royalty-free license to use, reproduce, adapt, publish, distribute, and display that content for purposes related to operating, improving, promoting, and supporting the Services.

You represent that submitted content:

• Is accurate and based on your genuine experience when presented as a review
• Does not violate another person’s intellectual-property, privacy, or publicity rights
• Does not contain unlawful, abusive, defamatory, threatening, obscene, or misleading material
• Does not contain malicious software or harmful code
• Discloses compensation or incentives when disclosure is required

We may review, decline, edit, or remove submitted content when reasonably necessary to enforce these Terms or applicable law.

13. Errors, Inaccuracies, and Omissions

The Services may occasionally contain typographical errors, incorrect product information, pricing errors, outdated availability, or other omissions.

Subject to applicable law, we may correct errors, update information, change or discontinue products, correct prices, cancel orders materially affected by an error, and issue an appropriate refund when an affected order cannot be fulfilled.

14. Prohibited Uses

You may access and use the Services only for lawful purposes.

You may not use the Services to:

• Violate applicable laws or regulations
• Infringe intellectual-property, privacy, publicity, or other rights
• Submit false, fraudulent, or materially misleading information
• Harass, threaten, abuse, discriminate against, or harm another person
• Impersonate another person or entity
• Submit viruses, malicious software, or harmful code
• Interfere with website security or operation
• Circumvent fraud-prevention, access, or security controls
• Collect personal information about others without authorization
• Send spam, phishing messages, or unauthorized solicitations
• Use the Services for unauthorized resale or fraudulent purchasing
• Engage in chargeback abuse, return fraud, or payment fraud
• Restrict or interfere with another person’s lawful use of the Services

We may suspend, restrict, or terminate access when we reasonably believe these Terms have been violated.

15. Automated Agents

This section applies when software takes autonomous or semi-autonomous action to access or interact with the Services on a user’s behalf.

Automated systems must:

• Identify themselves accurately where technically applicable
• Not impersonate ordinary human activity for the purpose of evading controls
• Not circumvent CAPTCHAs, rate limits, robot restrictions, security measures, or access controls
• Comply with applicable technical instructions and restrictions

We may reasonably limit or restrict automated access when necessary to protect customers, the Services, store content, or business operations.

16. Suspension and Termination

We may suspend or terminate an account or access to the Services when you violate these Terms, we reasonably suspect fraud or unauthorized activity, your use creates material legal or security risk, we are required to do so by law, or the Services are discontinued.

Termination does not eliminate obligations or amounts that arose before termination.

17. Disclaimer of Warranties

To the fullest extent permitted by law, the Services and products are provided on an “as available” and “as is” basis except for warranties expressly stated by TheJeMi or required by applicable law.

We do not guarantee that:

• The website will always be uninterrupted or error-free
• All content will always be current or complete
• Every product will meet every individual preference or expectation
• Colors will appear identically on every screen
• Every product will remain available
• Estimated delivery dates will always be met
• Third-party tools will always remain available

To the fullest extent permitted by law, we disclaim implied warranties to the extent they may lawfully be disclaimed.

Nothing in these Terms excludes a warranty, remedy, or consumer right that cannot legally be excluded or waived.

18. Limitation of Liability

To the fullest extent permitted by applicable law, TheJeMi and its owners, affiliates, employees, agents, contractors, suppliers, fulfillment partners, licensors, and service providers will not be liable for indirect, incidental, special, punitive, exemplary, or consequential damages arising from or relating to use of the Services or products.

Where applicable law does not permit a particular exclusion or limitation, that exclusion or limitation applies only to the maximum extent legally permitted.

Nothing in these Terms limits liability that cannot legally be limited.

19. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless TheJeMi and its affiliates, owners, employees, agents, contractors, licensors, suppliers, and service providers from third-party claims, losses, liabilities, damages, and reasonable legal costs resulting from your material breach of these Terms, violation of applicable law, infringement of another person’s rights, misuse of the Services, or unlawful content submitted through your account.

20. Severability

If a provision of these Terms is found to be unlawful, invalid, or unenforceable, it will be enforced to the fullest extent permitted and the unenforceable portion will be severed.

The remaining provisions will continue in effect.

21. Waiver and Entire Agreement

Our failure to enforce a provision of these Terms does not waive our right to enforce it later.

These Terms, together with the Privacy Policy, Returns, Exchanges & Refunds Policy, Shipping Policy, Gift Card Promotion Policy, and other policies posted through the Services, form the agreement governing your use of the Services.

22. Assignment

You may not transfer or assign your rights or obligations under these Terms without our prior written consent.

We may assign or transfer these Terms and related rights or obligations in connection with a lawful business reorganization, sale, merger, financing, change of control, or transfer of operations.

23. Governing Law

These Terms and any separate agreement through which we provide the Services are governed by the laws applicable in the jurisdiction where TheJeMi’s legal business entity is established, without regard to conflict-of-law principles, except where applicable law requires otherwise.

Mandatory consumer-protection laws applicable to you are not waived by this section.

Any dispute will be brought before a court or other forum having lawful jurisdiction over the parties and subject matter.

24. Changes to These Terms

You may review the current version of these Terms at any time on this page.

We may update these Terms to reflect changes to the Services, products, features, operations, legal requirements, security practices, Shopify, or third-party services.

Material changes will be communicated when required by applicable law.

Updated Terms become effective on the date stated at the top of this page or another date identified in the applicable notice.
